1. Introduction

Welcome to GravityX.

These Terms & Conditions govern your use of www.gravityxclothing.com (the “Website”) and your purchase of products from GravityX (“we”, “us” or “our”).

By using our Website, you agree to comply with the terms governing its use. When you place an order, the purchase terms applicable at that time will form part of your contract with us.

Please read these Terms & Conditions carefully before placing an order.

Nothing in these terms excludes, restricts or affects your statutory rights under applicable UK consumer protection legislation.

2. Business Information

Trading name: GravityX

Legal business name: GRAVITYXCLOTHING

Business structure: SOLE TRADER

Email: info@gravityxclothing.com

Website: www.gravityxclothing.com

GravityX is a UK-based clothing retailer specializing in gymwear, streetwear and fitness-inspired apparel.

The business operating this Website is responsible for fulfilling customer orders and complying with its legal obligations.

3. Website Use

By using our Website, you agree:

  • To provide accurate and truthful information when placing orders.
  • Not to use the Website for fraudulent or unlawful purposes.
  • Not to interfere with the Website’s functionality or security.
  • Not to attempt unauthorized access to our systems.
  • Not to upload malicious software or harmful content.
  • Not to reproduce or commercially exploit our content without permission, except where legally permitted.

We may restrict access to accounts or Website features where reasonably necessary to protect customers, investigate fraud, prevent unlawful activity or maintain security.

Any action we take will remain subject to applicable law.

4. Product Information

GravityX aims to ensure that product descriptions, specifications, prices, images and availability information are accurate and up to date.

Our products may include T-shirts, hoodies, joggers, shorts, vests, caps and other clothing or accessories.

Product colors and appearance

We make reasonable efforts to display product colors and details accurately.

However, colors may appear slightly different depending on screen settings, lighting and photography.

Minor visual differences may occur, but all products must correspond with their descriptions and meet applicable legal quality standards.

Sizing

Customers are encouraged to consult the size guides and measurements provided on individual product pages.

Measurements may be approximate where clearly stated. Customers should refer to the product-specific information before purchasing.

Your rights concerning incorrectly described or faulty products remain unaffected.

Product availability

All products are subject to availability.

We may update, discontinue or temporarily remove products from sale without prior notice.

If a product becomes unavailable after an order is placed, we will contact you and offer an appropriate solution, including a full refund where we cannot fulfill the order.

5. Orders and Contract Formation

By placing an order through our Website, you offer to purchase the selected products subject to these Terms & Conditions.

After submitting an order, you will normally receive an automated acknowledgement.

An automated acknowledgement does not necessarily constitute acceptance of your order.

A legally binding sales contract is formed when we send confirmation accepting your order, normally through a dispatch confirmation, unless we expressly accept it earlier.

We reserve the right to decline an order before acceptance for legitimate reasons, including:

  • Products being unavailable.
  • Payment authorisation failing.
  • A clear and obvious pricing or listing error.
  • Reasonable suspicion of fraud.
  • Delivery restrictions.
  • Circumstances preventing us from lawfully fulfilling the order.

If we cannot accept an order, we will notify you and refund any payment already taken for that order without undue delay.

Once an order has been accepted, cancellation and changes are governed by these terms and applicable consumer law.

6. Prices and Payments

All prices are displayed in pounds sterling (GBP) unless otherwise stated.

Prices include VAT where applicable.

Any delivery charges and other mandatory charges will be communicated before an order is submitted.

We reserve the right to change product prices and promotions at any time. However, price changes will not affect orders that have already been accepted.

Payments may be processed through payment methods made available at checkout, which may include:

  • Debit and credit cards.
  • PayPal.
  • Apple Pay.
  • Google Pay.
  • Other supported methods displayed at checkout.

Orders requiring an offline payment method will only be fulfilled in accordance with the payment instructions expressly agreed during checkout.

Payments are processed using third-party payment services. Their own terms and privacy notices may apply to payment processing.

We reserve the right to investigate suspected fraudulent transactions and take appropriate lawful action.

7. Shipping and Delivery

GravityX aims to process orders promptly.

Our currently advertised order-processing target is the same working day, with a typical shipping time frame of 5–9 business days. These are estimates unless a specific delivery date has been expressly agreed.

The applicable delivery options, estimated timescales and shipping charges will be shown during checkout or on the relevant delivery information page.

Delivery times may vary depending on stock availability, destination, public holidays and carrier operations.

Unless we agree otherwise, goods will be delivered without undue delay and no later than 30 days after the contract is made.

If delivery is delayed beyond an agreed deadline or the statutory delivery period, customers may exercise their rights under applicable law, including requesting delivery within an appropriate additional period or cancelling where legally entitled.

If you have expressly informed us before entering the contract that delivery by a particular date is essential, your applicable statutory rights will be respected.

Delivery responsibility

Where we arrange the delivery carrier, responsibility for the risk of loss or damage remains with GravityX until the goods are delivered into your physical possession or that of a person you have identified to receive them.

A parcel being marked as dispatched does not, by itself, transfer this risk to the customer.

Where you independently arrange a carrier not offered by us, different statutory rules concerning the transfer of risk may apply.

Ownership of goods transfers once we have received full payment and the goods have been delivered, subject to applicable law.

Incorrect delivery details

Customers must take reasonable care when entering delivery information.

If an address error is identified, please contact us as soon as possible.

We will make reasonable efforts to assist, but we cannot guarantee that an address can be changed after dispatch.

Responsibility for failed delivery arising from customer-supplied information will be assessed fairly and in accordance with applicable law.

International delivery

Delivery availability is determined by the destinations offered at checkout.

Where international delivery is available, any applicable customs charges, import duties and taxes must be disclosed as required by law before purchase.

8. Right to Cancel an Online Order

Most customers purchasing goods online have a legal right to cancel their order without giving a reason.

For eligible purchases, this right generally expires 14 days after the day on which you, or someone you nominate other than the carrier, receives the goods.

If an order contains multiple goods delivered separately, the period generally runs from receipt of the last item.

You may notify us of your decision to cancel using:

Email: info@gravityxclothing.com

You can also use the model cancellation form provided in our Shipping & Returns Policy, although its use is optional.

You must communicate your decision to cancel before the cancellation period expires.

Following cancellation, you must return the goods without undue delay and no later than 14 days after notifying us.

Returning goods

Customers are entitled to inspect and try on clothing in a manner reasonably necessary to establish its nature, characteristics and fit, as they would in a physical shop.

You should take reasonable care of any products you intend to return.

We may make a lawful deduction from a refund where handling beyond what is necessary has reduced the value of the goods.

Return postage

For eligible change-of-mind cancellations, customers are responsible for the direct cost of return postage, provided this was disclosed before purchase and unless we have agreed otherwise.

Where goods are faulty, damaged on arrival, incorrect or otherwise fail to meet statutory requirements, applicable consumer rights and return-cost obligations take priority.

Refunds

When a customer validly cancels an eligible online order, we will refund the payments due under applicable law.

Where the entire order is cancelled, this includes the cost of our least expensive standard delivery option, if delivery was charged.

Additional costs for an expressly selected premium delivery service need not be refunded beyond the standard delivery amount.

Refunds will be issued without undue delay and no later than 14 days after we receive the returned goods or receive evidence that they have been sent back, whichever is earlier.

Where no goods need to be returned, the relevant statutory refund deadline applies.

Refunds will normally be made using the original payment method, unless you expressly agree otherwise. We will not charge a refund fee.

9. Exceptions to Cancellation Rights

Certain products may be excluded from the statutory 14-day cancellation right where the law expressly permits.

Examples may include:

  • Goods made to the customer’s specifications or clearly personalized.
  • Qualifying sealed goods that are unsuitable for return for health or hygiene reasons once unsealed.

Any applicable exception will be identified clearly before the customer places an order.

Standard clothing sold in normal sizes or color options is not automatically excluded merely because it is manufactured or supplied after an order is placed.

Limited-edition products, discounted products and sale items are not automatically exempt from statutory cancellation rights.

These exceptions do not remove the customer’s rights concerning faulty, defective or incorrectly described goods.

10. Faulty, Damaged or Incorrect Products

GravityX is committed to supplying products that are:

  • Of satisfactory quality.
  • Fit for their intended purpose.
  • As described.
  • Compliant with applicable consumer protection legislation.

Under the Consumer Rights Act 2015, customers may be entitled to a refund, repair, replacement or price reduction where goods fail to meet these requirements.

Customers generally have a short-term right to reject faulty goods within 30 days.

After that period, other statutory remedies may apply, including repair or replacement and, where appropriate, a price reduction or final right to reject.

Where a fault becomes apparent within the first six months, the statutory presumption concerning whether it existed at delivery may apply.

To report a problem, please contact:

info@gravityxclothing.com

Include your order number and a description of the problem. Photographs may help us resolve issues more quickly but are not an absolute condition of exercising statutory rights.

Normal wear and tear, accidental damage and misuse are not automatically product defects.

Nothing in this section limits your legal rights.

11. Exchanges

We may offer exchanges for different sizes or colors, subject to availability and our published exchange procedure.

Exchanges offered as an additional service are separate from statutory cancellation and faulty-goods rights.

If a requested replacement is unavailable, we will discuss available alternatives.

Customers always retain their statutory rights where applicable.

12. Discount Codes and Promotions

GravityX may occasionally offer promotional codes, discounts, giveaways, competitions or other special offers.

Each promotion may have additional terms, which will be clearly communicated where applicable.

Unless otherwise stated in the particular promotion:

  • Promotional codes cannot be exchanged for cash.
  • Codes must be used within any clearly stated validity period.
  • Only eligible products may qualify for an offer.
  • Promotional codes cannot normally be applied retrospectively.
  • Offers may be subject to stated usage limits.
  • Codes must not be obtained or used fraudulently.

We reserve the right to withdraw or correct promotions where reasonably necessary, subject to existing contractual obligations and consumer law.

Nothing in these terms allows GravityX to unfairly withdraw an already accepted order or mislead customers about an offer.

Gift vouchers and competitions may be governed by additional specific terms, which will be made available when offered.

13. Intellectual Property

The GravityX name, brand identity, original logos, clothing artwork, website copy, images, graphics and other original creative content may be protected by copyright, trademark rights and other intellectual property laws.

Unless expressly stated otherwise, intellectual property rights owned by GravityX remain the property of GravityX or its respective rights holders.

You must not, without appropriate permission:

  • Reproduce original GravityX designs for commercial purposes.
  • Manufacture or distribute counterfeit GravityX merchandise.
  • Use GravityX branding to falsely suggest endorsement or affiliation.
  • Copy or redistribute protected website content unlawfully.

These restrictions do not prevent acts permitted by law or the exercise of legitimate consumer rights.

Third-party materials remain the property of their respective owners.

If you believe content on our Website infringes your intellectual property rights, please contact info@gravityxclothing.com.

14. Customer Reviews and User-Generated Content

Customers may submit reviews, feedback or other content where this functionality is available.

You agree not to submit content that is unlawful, fraudulent, defamatory, threatening or knowingly misleading.

Reviews must reflect genuine experiences.

We may moderate or remove content where reasonably necessary to comply with law, protect users or maintain the integrity of our review system.

GravityX will not knowingly publish fabricated customer reviews or misrepresent endorsements.

Submitting a review does not automatically give GravityX unrestricted ownership of your photographs or other original materials.

Where we wish to reproduce customer photographs, videos or testimonials for advertising beyond the purposes clearly agreed at submission, we will obtain appropriate permission.

15. Website Availability and Security

We aim to keep our Website accessible and functioning correctly.

However, temporary interruptions may occur because of maintenance, technical faults, third-party services or circumstances outside our reasonable control.

We may update, modify or suspend Website features where reasonably necessary.

We do not guarantee uninterrupted access.

Nothing in this section affects obligations concerning accepted customer orders or other non-excusable legal rights.

16. Third-Party Websites and Services

Our Website may contain links to third-party websites, social media platforms and payment providers.

These services may operate under separate terms and privacy policies.

GravityX is not responsible for independent third-party content or services that it does not control, except where responsibility arises under applicable law.

17. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits our liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Breach of rights that cannot lawfully be excluded under the Consumer Rights Act 2015.
  • Any other liability that cannot lawfully be restricted.

Where we breach our contract, we are responsible for reasonably foreseeable loss or damage caused by that breach, subject to applicable law.

We are not generally responsible for losses that are not reasonably foreseeable or for losses resulting solely from circumstances outside our control, except where the law provides otherwise.

Our products are supplied primarily for personal consumer use. Where products are purchased for commercial purposes, any separate business terms agreed with us may apply.

This section does not limit statutory remedies or liability where doing so would be unlawful or unfair.

18. Events Outside Our Reasonable Control

We will not be treated as responsible for certain delays caused solely by events beyond our reasonable control where the law allows this.

Examples may include major transport disruption, natural disasters or significant interruptions to essential services.

If such an event affects an order, we will take reasonable steps to notify affected customers and explain the available options.

Your rights to cancel, obtain a refund or exercise statutory remedies remain unaffected where applicable.

19. Privacy and Cookies

We process personal information in accordance with applicable data protection law, including the UK GDPR and Data Protection Act 2018.

Our Privacy Policy explains what information we collect, why we use it, how it may be shared and the rights available to individuals.

Our Cookie Policy explains how cookies and similar technologies are used.

Where consent is legally required, it will be requested separately.

20. Changes to These Terms

We may revise these Terms & Conditions to reflect changes in our business, Website functionality, operating procedures or applicable law.

The latest version will be published on our Website with its effective date.

The terms applicable to a customer order are generally those in force when the contract was made, unless a lawful change is separately agreed.

Changes will not retrospectively remove existing contractual or statutory rights.

21. Governing Law and Disputes

These Terms & Conditions are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply.

Consumers resident in Scotland or Northern Ireland retain any mandatory protections and rights to bring proceedings in courts available to them under applicable law.

Consumers in other jurisdictions retain any mandatory protections that cannot lawfully be excluded.

If a dispute arises, we encourage customers to contact us first so that we can investigate and attempt to reach a fair resolution.

Nothing in these terms prevents a customer from pursuing legal remedies available to them.

22. Severability

If any provision of these terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply so far as legally possible.

No provision will be interpreted as overriding mandatory consumer protection law.
